Terms of Service
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Eligibility
1.1 Age Requirements
- You must be at least 13 years old to create an account on our Services.
- If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use our Services with the consent of a parent or legal guardian. By allowing a minor to use our Services, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's use.
- Event applications for minors must be submitted with parental or guardian awareness.
1.2 Account Responsibility
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately at security@homenetmen.org if you suspect unauthorized access.
- You may not share your account or create multiple accounts for the same person.
2. Account Registration
2.1 Accurate Information
When creating an account, you agree to provide accurate, current, and complete information. You agree to update your information promptly if it changes.
2.2 Authentication Methods
You may register using an email address, phone number, or a supported social login provider (Google, Facebook, Apple, or Microsoft). By using a social login provider, you authorize us to access certain information from that provider as described in our Privacy Policy.
2.3 Account Security
We implement security measures including rate limiting, account lockout, and device/location anomaly detection. You agree to choose a strong password, not reuse passwords from other services, log out of shared devices after use, and report any security concerns to security@homenetmen.org.
3. Acceptable Use
3.1 Permitted Use
Our Services are provided for accessing information about Homenetmen and its programs, managing your account and profile, submitting applications for events and programs, receiving notifications and communications, and participating in our community.
3.2 Prohibited Conduct
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Services or other users' accounts
- Interfere with or disrupt the Services, servers, or networks
- Use automated tools (bots, scrapers, crawlers) without our written permission
- Submit false, misleading, or fraudulent information
- Impersonate another person or entity
- Upload or transmit viruses, malware, or other harmful code
- Circumvent, disable, or interfere with security features
- Use the Services to send unsolicited messages or spam
- Attempt to reverse-engineer, decompile, or disassemble any part of the Services
- Use the Services in a manner that could damage, disable, or impair our infrastructure
- Harvest or collect personal information of other users without their consent
3.3 Content Standards
Any content you submit must not be false, misleading, or deceptive; infringe on intellectual property rights; contain defamatory, obscene, or offensive material; contain personal information of others without consent; or violate any applicable law.
4. Event Applications and Programs
4.1 Application Submissions
When you submit an application for an event or program:
- You certify that all information provided is accurate and complete
- You understand that submitting an application does not guarantee acceptance
- You agree that your application data may be reviewed by authorized organizers and staff
- You acknowledge that medical information is collected solely for safety purposes
4.2 Medical Information
By providing medical information in an event application:
- You consent to this information being shared with event medical staff and authorized leadership for safety purposes
- You understand that this information will be handled as sensitive data with restricted access
- You agree to update your medical information if it changes before or during the event
- For minors: the parent/guardian confirms they are authorized to provide this information
4.3 Event Participation
Participation in events and programs is subject to acceptance by event organizers, compliance with event-specific rules and codes of conduct, any additional waivers or agreements required, and applicable fees as communicated during the application process.
4.4 Right to Refuse or Revoke
We reserve the right to decline any application at our sole discretion, revoke acceptance or participation for violation of these Terms or event rules, and cancel or modify events due to circumstances beyond our control.
4.5 Assumption of Risk and Liability Waiver
Voluntary Participation and Assumption of Risk
Participation in Activities is entirely voluntary. You acknowledge that Activities may involve inherent risks, including but not limited to:
- Physical activities, sports, athletics, competitions, and outdoor recreation
- Domestic and international travel
- Exposure to weather conditions, natural hazards, and varying environmental conditions
- Communal living conditions and shared facilities
- Interaction with other participants of varying ages and abilities
- Risks associated with food preparation and consumption in group settings
You voluntarily assume all risks — known and unknown, foreseeable and unforeseeable — arising from your participation in Activities.
Waiver and Release of Claims
- Bodily injury, illness, or death
- Property damage or loss
- Emotional distress
- Medical expenses
- Loss of income or opportunities
Emergency Medical Authorization
In the event of a medical emergency during an Activity, you authorize the Released Parties to:
- Seek and consent to emergency medical treatment, first aid, or hospitalization on your behalf (or on behalf of the minor for whom you are the parent/guardian)
- Share your medical information with medical professionals providing emergency care
- Make medical decisions if a parent or guardian cannot be reached in a timely manner
You agree to bear all costs associated with any medical treatment provided.
Photo, Video, and Media Release
You hereby grant Homenetmen an irrevocable, royalty-free, perpetual, worldwide, fully sublicensable, and transferable license to use, reproduce, modify, edit, crop, adapt, publish, distribute, display, perform, and create derivative works from any Media in which you appear, in any format or medium now known or hereafter developed, for any purpose, including but not limited to:
- Organizational publications, newsletters, reports, and printed materials
- Websites, social media accounts, and digital platforms (including third-party platforms)
- Promotional, marketing, fundraising, and advertising materials
- Educational, training, and documentary materials
- Event documentation, archives, and historical records
- Press releases and media coverage
- Merchandise and branded materials
You agree that:
- Homenetmen owns all rights to Media it produces and is not required to compensate you for any use
- You waive any right to inspect, approve, or receive credit for the finished materials or their use
- You waive any claims related to distortion, alteration, optical illusion, or use in composite form
- You release the Organization Parties from any and all claims arising from the capture or use of Media, including claims for invasion of privacy, right of publicity, defamation, copyright, or emotional distress
- This release applies to Media captured at any Activity, on organizational premises, or at any location in connection with organizational programs
- This license survives the termination of your account or membership and has no expiration date
- Notify us in writing at privacy@homenetmen.org before the Activity begins
- Identify yourself to event photographers/videographers on-site
- We will make reasonable efforts to minimize your inclusion, but we cannot guarantee complete exclusion from all Media, particularly in group photos, crowd shots, background appearances, and live recordings
- If you identify specific published Media and request removal, we will make reasonable efforts to remove or obscure your likeness from materials under our direct control. However, we cannot recall printed materials, remove Media shared or republished by third parties, or alter historical/archival records
Your submission of an event application constitutes your acceptance of this media release. If you do not agree, do not submit an application or attend the Activity.
Media Release for Minors: For participants under 18, the parent or legal guardian submitting the application grants this media release on behalf of the minor with the same scope and terms described above.
Parental/Guardian Waiver for Minors
- Represents that they are the legal parent or guardian with full authority to agree to these terms
- Agrees to all provisions of this Section 4.5 on behalf of the minor
- Waives and releases all claims on behalf of the minor and the minor's heirs, executors, administrators, and assigns
- Authorizes emergency medical treatment for the minor as described above
- Accepts financial responsibility for any damages caused by the minor during Activities
- Acknowledges that they have explained the nature of the Activities and associated risks to the minor
5. Mobile Application
5.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the MyHomenetmen mobile application on a device you own or control, solely for your personal, non-commercial use in connection with our Services.
5.2 App Store Terms
Your use of the mobile application is also subject to the terms of the platform from which you downloaded it (Apple App Store or Google Play Store). In the event of a conflict, the app store terms shall prevail with respect to your use of the app store.
5.3 Push Notifications
The app may send you push notifications about announcements, events, and updates. You can opt out at any time through your device settings. Opting out does not affect your ability to use other features of the app.
5.4 Updates
We may release updates from time to time. Some updates may be required for continued use. Where possible, updates may be delivered over-the-air without requiring a new download from the app store.
5.5 Third-Party Acknowledgments
The mobile application uses Firebase Cloud Messaging (Google LLC) for push notification delivery and Expo (650 Industries, Inc.) for app development and over-the-air updates.
6. Intellectual Property
6.1 Our Content
All content, features, and functionality of the Services are owned by Homenetmen or its licensors and are protected by copyright, trademark, and other intellectual property laws.
6.2 Trademarks
Homenetmen, MyHomenetmen, and associated logos and marks are trademarks of Homenetmen. You may not use these marks without our prior written permission.
6.3 Your Content
By submitting content through our Services (such as profile photos or application materials), you grant us a non-exclusive, royalty-free, worldwide license to use, store, and process that content solely for the purpose of providing and improving our Services. This license terminates when you delete your content or account, except where retention is required for legitimate organizational or legal purposes.
7. Privacy
Your use of our Services is also governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. By using our Services, you acknowledge that you have read and understood our Privacy Policy.
8. Disclaimers
8.1 "As Is" Basis
8.2 No Guarantee of Availability
We do not guarantee that the Services will be available at all times or without interruption. We may modify, suspend, or discontinue any part of the Services at any time without notice.
8.3 Third-Party Content
Our Services may display content from or link to third-party websites and services. We do not endorse, control, or assume responsibility for any third-party content, products, or services.
9. Limitation of Liability and No Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

- YOUR USE OF, OR INABILITY TO USE, THE SERVICES
- ANY CONTENT, INFORMATION, OR MATERIALS AVAILABLE THROUGH THE SERVICES
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS
- ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICES
- ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE SERVICES
- YOUR PARTICIPATION IN ANY EVENTS, PROGRAMS, OR ACTIVITIES
- ANY PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, OR DEATH ARISING FROM YOUR PARTICIPATION IN ACTIVITIES
- ANY ACTIONS OR OMISSIONS OF OTHER USERS OR PARTICIPANTS
9.2 Complete Exclusion of Damages
9.3 Narrow Exception
9.4 Jurisdictional Limitations
Some jurisdictions do not allow the complete exclusion of liability or certain limitations on damages. In such jurisdictions, the liability of the Organization Parties is excluded and limited to the absolute minimum extent permitted by applicable law. Nothing in these Terms shall exclude or limit liability that cannot be lawfully excluded or limited.
9.5 Essential Basis of the Agreement
10. Indemnification
You agree to indemnify, defend, and hold harmless Homenetmen, its officers, directors, volunteers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any content you submit through the Services
- Your participation in events or programs
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [state], United States, without regard to its conflict of law provisions.
11.2 Informal Resolution
Before filing any formal legal proceeding, you agree to first contact us at security@homenetmen.org and attempt to resolve the dispute informally for at least 30 days.
11.3 Jurisdiction
If informal resolution is unsuccessful, any legal action or proceeding shall be brought exclusively in the federal or state courts located in [COUNTY], [STATE], and you consent to the personal jurisdiction of such courts.
11.4 Class Action Waiver
12. Account Termination
12.1 By You
You may delete your account at any time by contacting us at security@homenetmen.org. Upon deletion, your personal data will be anonymized in accordance with our Privacy Policy, any pending event applications may be withdrawn, and your push notification token will be unlinked.
12.2 By Us
We may suspend or terminate your account at any time if you violate these Terms, engage in harmful conduct, your account has been inactive for an extended period, or we are required to do so by law. We will make reasonable efforts to notify you before or promptly after any termination.
12.3 Effect of Termination
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive (including Sections 6, 8, 9, 10, 11, and 13).
13. General Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Homenetmen regarding the Services.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
13.3 Waiver
Our failure to enforce any provision shall not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not assign or transfer your rights or obligations without our prior written consent. We may assign our rights and obligations without restriction.
13.5 Notices
We may send you notices via email, push notification, or by posting on our Services. Notices to us should be sent to security@homenetmen.org.
13.6 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or infrastructure failures.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify you via email or a prominent notice on our Services. Your continued use after the effective date constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Services and may request deletion of your account.
